I suppose nowhere in the world are courts closed for 'summer vacations' as they are in Pakistan. Courts are closed for two long months. For that reason cases pile up by the end of those two months. The number of judges are few and the number of cases run for into hundreds at times., every single day. Court sessions are only from 9.30 AM to 1.30 PM with a tea break in between. The cases which are not heard on that day are given a new date or never given any. The lawyer has to get a new date provided a judge is available.
Before any case can have its day in court - it has to be registered - the registrar is a very powerful person he can choose to reject a case if he wants to. After the case is registered - the bailiff takes his time to send the case to the respondents. The respondents hire their lawyers who prepare a reply. When the reply is sent a rebuttal is sent. There is such a thing called Katchi Peshi - meaning rough presentation of the case - if the petitioner is lucky his Katchi Peshi will be heard. A whole lot of rigmarole. Apparently there is no direct way to get the case heard in court without any problems. One has to wait in line - there are other cases to be heard.
Civil cases can take a lifetime. I have seen petitioners die and the cases being decided after their death - sometimes not even then. For hundred cases there should be hundred judges so that every judge should not be handling more than three or four cases to hear on any given day.
There should be no such thing summer vacations. In an age which there are air conditioners - why should the courts be closed. Judges as perk of their job can take their personal holidays but there should be other judges on call. Ideally all courts should be running round the clock, so that cases are heard without wasting any time. but unfortunately does not happen.
It is high time there should massive judicial reform. Delayed justice results in complete hopelessness. It allows the rich and the powerful the chance to get away and the poor not being able to bear the cost of contesting a case - give up, hence justice is not done it is denied. Many times lawyers and advocates are absolutely corrupt they take money from an impoverished person to contest his case, the side which is much richer can bribe the lawyer. If the the petitioner has money, he will have to hire another lawyers.
The entire legal procedure is inherently flawed. A petitioner should not have to wait years before getting heard and the case settled in time. Of course justice hurried is justice buried but then justice delayed is justice denied also. The latter is more common than the former.
The courts should be bigger, more space allocated for courtrooms. More judges should be appointed and the procedure of hearing of cases should not take long. Which in itself is torture. The intricacies of legal procedures are so strange that it becomes impossible for a lay person to understand what is really going on. Much of the delays are also caused by the lawyers. It is an unnecessarily very complex and strange system which is beyond the comprehension of the layman. It should be a simple and easy to understand for ordinary one.
